This notice identifies the operator of https://metalmagazine.eu, sets out the terms for using its editorial website and explains how we handle personal data when you contact METAL, subscribe to its newsletter or browse the site.

METAL is a publication of Jazzmetal SL, which operates the website and is the controller of personal data.

USE OF THE WEBSITE

The website provides METAL editorial content and access to its contact channels, newsletter and shop. Browsing does not constitute consent to receive advertising or to any data processing that requires specific permission.

You agree to use the website lawfully, to respect third-party rights and not to introduce malicious software, attempt unauthorised access, disrupt the service or use published contact details to send unsolicited commercial communications.

Services with specific terms are also governed by the terms presented before you use or purchase them.

INTELLECTUAL PROPERTY

Articles, photographs, videos, designs, logos and other content are protected by intellectual and industrial property rights held by Jazzmetal SL or their respective owners. Accessing the website does not transfer any of these rights.

Reproduction, distribution, adaptation or communication to the public requires permission from the rights holder, except where permitted by law. You may share links to articles provided you do not suggest a sponsorship or partnership that does not exist.

Sending material to the editorial team does not in itself assign any rights. Any publication will be agreed in advance with the author or rights holder.

If you believe that content infringes your rights, email metal@metalmagazine.eu identifying the content and the reason.

LINKS AND LIABILITY

The website may link to third-party content or services governed by their own terms and policies. A link does not imply that METAL endorses the linked content.

Jazzmetal SL strives to keep the website and its information up to date, but errors, interruptions or technical incidents may occur. Reports of incidents or allegedly unlawful content will be reviewed and appropriate action taken.

Jazzmetal SL’s liability is governed by applicable law. Nothing in this notice excludes liability that cannot lawfully be excluded or limits your mandatory rights.

ONLINE SHOP

Purchases of printed magazines and digital products take place in the shop linked from the website, operated by Jazzmetal SL, and are governed by the purchase, delivery, returns and privacy terms shown in the shop before an order is placed.

Enquiries and requests

We process your identification and contact details and the information you send us to answer enquiries, requests and proposals. Where the request relates to a prospective or existing contract, the legal basis is taking steps prior to entering into a contract or performing it; otherwise, our legitimate interest in responding to the communications we receive.

Providing data is voluntary, but without it we cannot handle your request. Please do not send us sensitive data or unnecessary information about other people.

We process your email address and any details you provide when subscribing in order to send you the METAL newsletter. The legal basis is your consent. The newsletter is sent with Squarespace Email Campaigns, which records, in aggregate and per recipient, whether a message is opened and which links are clicked; we use this only to understand interest in our content and improve the newsletter.

You can unsubscribe at any time using the link in every email or by writing to metal@metalmagazine.eu. Unsubscribing does not affect the lawfulness of earlier mailings. Subscribing to METAL does not subscribe you to the ACERO newsletter.

Browsing, statistics and security

To serve the website and protect it against attacks and misuse, we process technical connection data (IP address, browser, pages requested) and log technical errors. The legal basis is our legitimate interest in providing a secure, properly functioning service.

With your consent, we use Google Analytics to obtain usage statistics. Cloudflare Web Analytics also produces aggregate statistics without cookies or identifying users. See the Cookie policy for details and to change your choice.

Editorial content

Articles may include data about people who are interviewed, photographed or mentioned. This processing is based on freedom of expression and information (Article 85 GDPR). If you appear in our content and wish to request a correction or a review, email metal@metalmagazine.eu; we will consider each case.

Minors

We do not knowingly collect personal data from children under 14. If you are under 14, please do not send us personal data without the permission of your parents or guardians.

Retention

Enquiries and requests: up to 12 months after the last contact, unless they lead to a contractual relationship, in which case data is kept for its duration and for the legally required periods afterwards.
Newsletter: while your subscription is active. After you unsubscribe we keep only your email address on a suppression list so that we do not email you again.
Google Analytics: 14 months. Technical and error logs: 90 days maximum.

Where legal obligations or potential liabilities apply, the necessary data will be kept blocked for the applicable limitation periods.

Service providers

We work with the following providers, which process data on behalf of Jazzmetal SL under data processing agreements:

Google Cloud EMEA Ltd. / Google LLC: hosting of the website and its databases, in the European Union (Belgium).
Cloudflare, Inc.: content delivery, edge caching, storage of images and files, security of the website and cookieless aggregate statistics.
Google Ireland Ltd. / Google LLC: Google Analytics, with your consent.
Squarespace Ireland Ltd. / Squarespace, Inc.: subscription forms and newsletter delivery.
Functional Software, Inc. (Sentry): logging of technical errors.

We do not share your data with other companies for marketing purposes. We only disclose data to authorities where required by law.

International transfers

Cloudflare, Google, Squarespace and Sentry may process data in the United States. These transfers are covered by the EU-U.S. Data Privacy Framework, in which these companies participate, and by the European Commission’s standard contractual clauses included in their agreements. You can request further information at metal@metalmagazine.eu.

Your rights

You can exercise your rights of access, rectification, erasure, objection, restriction of processing and portability by emailing metal@metalmagazine.eu or writing to Jazzmetal SL, Aribau 168 1º1ª, 08036 Barcelona, Spain, with the reference “Data protection”. We will reply within one month. We will only ask for additional information to identify you where necessary.

You may withdraw any consent you have given and object to direct marketing at any time. If you believe we have not handled your rights properly, you can lodge a complaint with the Spanish Data Protection Agency (www.aepd.es) or the supervisory authority where you live.

UPDATES, LANGUAGE AND APPLICABLE LAW

We may update this notice to reflect legal or service changes; the date of the latest update appears at the top. Changes do not apply retroactively and do not replace any consent that must be obtained again.

This notice is also available in Spanish on request. Spanish law applies, without prejudice to mandatory rules and the rights granted to consumers by law. Disputes will be heard by the courts that are competent under applicable law.
